Model Template Resolution in Support of the For Our Freedom Amendment

Below is a model state/local resolution to support the For Our Freedom Amendment to the United States Constitution.

WHEREAS, the United States of America was founded on the revolutionary idea that the people are sovereign, and that all legitimate political power must ultimately flow from the consent of the people;

WHEREAS, the Declaration of Independence recognizes that “Governments…deriv[e] their just powers from the consent of the governed”;
WHEREAS, the Constitution of the [State/Commonwealth of ___] recognizes that [insert language from your State’s constitution to the effect that political power flows from the people];

WHEREAS, We the People have compelling sovereign interests in fostering robust political debate, advancing self-government by ensuring that political representatives are aligned with their constituents, securing the liberty and political equality of our citizens, guarding against corruption, and advancing federalism and the interests of the several States;

WHEREAS, We the People recognize that these compelling sovereign interests are implicated in various ways by different campaign finance policies;

WHEREAS, the unconstrained ability of financial power to purchase political power has a deleterious effect on our ability to self-govern because it fundamentally corrodes the necessary bonds of trust between We the People and our political representatives;

WHEREAS, [if applicable, insert language from your State’s constitution regarding campaign finance];

WHEREAS, reasonable regulations on how money is used to influence elections is necessary (1) to secure the rights of all citizens of [your State] to be represented and participate in elections and self-government, and (2) to protect the integrity of elections and government against out-of-state and foreign interests and the undue influence of wealthy special interests, whether of corporations, unions, or others;

WHEREAS, over the past five decades, the Supreme Court has interpreted the United States Constitution in ways that prevent We the People, and our state and federal legislators, from enacting reasonable campaign finance policies;
WHEREAS, the framers wisely drafted Article V of the Constitution to provide for amending of our Constitution when necessary to make it, and our Union, more perfect and to protect and preserve self-government and liberty.

THEREFORE, We the People of [your State/Commonwealth] and the legislature of [your State] hereby call upon the United States Congress to propose and send to the States for ratification a Constitutional amendment to clarify that States may set reasonable limits on the spending of money to influence elections in the States, and that Congress may set reasonable limits on the spending of money to influence Federal elections, and that, in so doing, the States and Congress may distinguish between natural persons and non-human entities such as corporations, unions, and artificial intelligences, and

BE IT FURTHER RESOLVED, that a suitable copy of this resolution be prepared and submitted to the Speaker of the United States House of Representatives, the Minority Leader of the House of Representatives, the Majority Leader of the United States Senate, the Minority Leader of the United States Senate, and to each member of the [your State] Congressional delegation.
